Closing arguments in Nixzmary trial

Lawyer says evidence points towards mother
NEW YORK During his closing arguments on Wednesday in Brooklyn, Jeffrey Schwartz conceded that defendant Cesar Rodriguez "is guilty of child abuse."

But he added: "You have not seen evidence in this courtroom that has proven murder or manslaughter charges."

The prosecution closing was expected later Wednesday.

Rodriguez is accused of beating the little girl to death for stealing some yogurt.

His lawyer reminded jurors of an inmate's testimony that - while behind bars - Nixzmary's mother had "confessed to the death blow that ended the life of her daughter."
