Family sues MSG over DWI crash

JERSEY CITY An attorney for Carlos Zelaya says the arena served alcohol to off-duty Jersey City police officer Kevin Freibott even though he was intoxicated.

Freibott's Jeep Cherokee rear-ended the car in which the boy was riding on the Pulaski Skyway. He had attended a college basketball game at the Garden that evening.

Freibott's blood-alcohol level was more than three times the legal limit. He has been sentenced to 11 years in prison.

A spokesman for the Garden said the arena adheres to strict policies on serving alcohol and is not responsible for the accident.

Freibott pleaded guilty to vehicular homicide and must serve six years, 10 months and six days before being eligible for parole.

He got the maximum term for causing the crash, which killed the boy and put his mother in a coma.

Jersey City hired Freibott despite his history of driving offenses. He had been fired from the Middletown Township Police Department after an accident.
