Lawyer asks Sept. 11 settlements be reinstated

NEW YORK - Lawyer Jonathan Asrael wrote in papers submitted Monday in federal court in Manhattan that the settlements rejected by Judge Alvin Hellerstein should be reinstated.

Hellerstein nearly two weeks ago said the $28.5 million in settlements on behalf of four "modest wage earners at the Pentagon" was excessive.

Asrael says the settlements were fair under Virginia law, which allows damages for such things as sorrow and mental anguish while New York law does not.

He says rejecting the settlements for the families had "rubbed raw the wounds of September 11." He says it also left the families disappointed or angry.
