Prosecutors say the 40-year-old Parks had been mugged by four young men, and was calling 911 when he saw Byas. They say he chased Byas and stabbed him 15 times because he mistook him for one of the robbers.
Parks' lawyer, Sol Schwartzberg, says Parks' abdomen was slashed open and he couldn't have chased Byas anywhere.
Parks was ordered to return to court Oct. 15.
