They say the 46-year-old victim was approached by the two teens on Hillwood Place. The boys reportedly displayed what appeared to be a handgun and demanded money. The victim refused to turn over his property and tried to grab the suspects, police said.
When the boys fled on foot, he reportedly gave chase and caught them in the gas station. The gun used in the incident was recovered, and the investigation revealed the gun was an imitation hand gun.
According to the robbery statute in the New York State Penal Law, a suspect only has to display what appears to pistol, revolver, rifle, shotgun machine gun or other firearm. The firearm does not have to be real.
Authorities say this is a dangerous situation for youths who do not know that a fake firearm is just a dangerous to display as a real firearm.
The two boys are charged with first-degree attempted robbery. Their names will not be released due to their ages.
