NY senator arraigned on assault charge

NEW YORK The Democrat is accused of slashing Karla Giraldo's face during a jealous rage.

Judge William Erlbaum refused to lift an order of protection against Monserrate. The judge viewed surveillance footage in chambers. It showed the pair on the night of the incident, Dec. 19, in the hallway of Monserrate's New York City apartment building.

The gash over her eye required 25 stitches.

Both called it an accident. Monserrate told police he tripped while holding a glass of water and said the glass accidentally hit Giraldo.

His next court date is June 26.

Fellow senators have discussed setting up a fund to help pay Monserrate's lawyers.
