Emotional hearing over daycare death

QUEENS He cannot understand why he won't see his baby boy ever again.

Eleven-month old James Farrior the Third drowned in a bucket of mop water while in the home daycare of 28-year old Crystal Khan.

The child's family was in court Tuesday night as Khan faced a judge for her arraignment.

After she was charged with child endangerment a misdemeanor, the baby's mother left in tears, clutching her sons blanket. Other relatives were incensed and left the courtroom screaming.

Queens D.A. Judge Richard Brown explained before the arraignment that Khan's charges could be upgraded to criminally negligent homicide based on the baby's autopsy.

It's unknown how long he was in the bucket, which was three-quarters filled with water.

The suspect allegedly said her own kids, ages 2 and 4, woke her up and she saw him submerged headfirst.
