Lawyers: Jr. Gotti has kidney stones

July 8, 2009 11:06:11 AM PDT
Lawyers say it's "cruel and unusual punishment" to leave John "Junior" Gotti in a New York City jail cell while he's suffering from "agonizing" kidney stones. The defense has filed court papers trying to get Gotti freed on bail while he awaits a September racketeering retrial.

A hearing was scheduled Wednesday afternoon.

In a previous get-out-of-jail bid, they said the Gambino crime family heir is an educational achiever. He scored a 3.5 grade point average when he took college classes in an upstate prison.
