According to the D.A.'s office, Smith owes $32,799 in taxes, a total that does not include fees or penalties.
He was charged with failure to pay personal income tax and earnings, as well as misdemeanor failure to pay taxes.
Smith will be arraigned at Staten Island Criminal Court later today. He faces a maximum of four years behind bars.
