He's also accused of possessing a photo of the girl engaged in a sex act.
Prosecutors say the mother found the photo on the defendant's cell phone and contacted police, but Sagastume Morales fled to his native Guatemala.
If convicted, Sagastume Morales could be sentenced to up to 25 years in prison.
