Authorities say 50-year-old Antonio Toumbas, of Patchogue, was driving his boat when one of his passengers fell out into the Great South Bay.
Toumbas allegedly did not tell police about the incident and would not let his other passenger call 911.
Toumbas is charged with reckless endangerment.
The passenger was later found alive, clinging onto a crab trap.
