Family of shootout victim plans to sue city

BROOKLYN

The notice claims that police officers fired what it calls an "errant" bullet that killed 56-year-old Denise Gay as she sat outside her Brooklyn home on Sept. 5.

It was filed with the office of the comptroller, and describes plans to seek $10 million in damages.

Ballistics tests showed the fatal bullet didn't come from the shootout suspect. It's unclear whether it came from a police weapon or some other gun.
