The Daily News is reporting that Diana Cloud's lawyer will ask a judge to release her into a hospice care.
The 47-year-old was serving a 15-month sentence for shoplifting when a judge released her so she could get a heart transplant.
However, she was denied the transplant because she did not quit smoking.
Now, her lawyer says she has only weeks to live.
