The child was 22 months old at the time.
Andre Curry's attorney successfully argued to get bond reduced. The judge made his ruling and after that Curry told the court that he would comply with everything the judge said, meaning Curry could walk out of the Cook County Jail Friday night after his family or friends post 10 percent of his new, lower bond.
"He didn't do anything to harm this child," said Brandi Phillips, the defendant's mother. "She was never hurt, never in danger. He just made a mistake."
The mother of Andre Curry said he is not a danger to his daughter after the court reduced his bond but ordered him to stay away from his child and the girl's mother.
"That's the worst feeling in the world," said Yesmin Doss, the child's mother.
Friday afternoon, a Cook County judge reduced Curry's bond from $100,000 to $30,000, although he is accused of binding the little girl with tape and posting the picture on Facebook.
The 21-year-old pleaded not guilty to aggravated domestic battery and unlawful restraint.
"We always said that we understood why the public felt the way that they did, and we understand why the state's attorney had to do what she had to do," said Corey Barrett, Curry's pastor.
The case made headlines after Curry was arrested last month for allegedly putting a photo of his 22-month-old daughter on his Facebook page. It appeared on websites liked SmokingGun.com.
"Now we're at a turning point," said Phillips. "The courts have the information, so now the ball is in their court."
The court heard from a department of children and family services case worker about their ongoing investigation before prosecutors argued against the bond reduction, Assistant State's Attorney Kathleen Muldoon saying:
"Regardless of whether he thinks it's a joke or not it's a severe offense. We think the bond is appropriate given the severity of the crime."
Curry's attorney says his client was just trying to be funny and didn't harm his daughter.
Zachary Harrison says Curry will hopefully walk out of the Cook County Jail Friday after his family posts the money necessary to secure his freedom.
"He's a real good guy. A real good guy. He doesn't deserve to be in jail," said Hamilton, Curry's attorney.
Special conditions still apply to the new reduced bond. Curry still cannot have access to the Internet and cannot have contact with anyone under the age of 18.
Curry is due back in court in March.
