NYPD rape trial resumes Monday

NEW YORK

Pena is charged with predatory sexual assault and rape, and a conviction could mean life in prison.

On Friday, Pena faced his accuser, a 25-year-old second grade teacher.

She sobbed as she testified that Pena attacked her and threatened to shoot her in the face if she resisted.

Pena remains jailed in lieu of $1 million bail.

Through his lawyer, Pena has admitted attacking the woman, but claimed he never managed to have intercourse during the assault.

New York law imposes lighter punishments on would-be rapists who fail to complete the act.
