Grandmother in deadly Upper West Side crash released from hospital

UPPER WEST SIDE

Katia Gutierrez was released from St. Luke's Hospital to continue her recovery at home.

Gutierrez was walking with 4-year-old Ariel Russo at the intersection of 97th Street and Amsterdam Avenue on June 4 when they were struck by an out-of-control car driven by an unlicensed teenager.

Russo died at the scene, and her family is suing New York City for $40 million over a four-minute delay in dispatching an ambulance.

The 17-year old driver, Franklin Reyes, is charged with vehicular manslaughter. He had only a learner's permit when he attempted to flee police pulling him over for reckless driving.
