The family of a New York college student killed in a confrontation says it needs the report to prepare a wrongful death lawsuit.
State Supreme Court Justice Norman Janowitz ruled Tuesday that Nassau has 30 days to turn over the report to the family of Andrea Rebello.
The 21-year-old Hofstra University student was fatally shot by a police officer in May. An intruder, identified as Dalton Smith, had taken her and several others hostage in their off-campus home in Uniondale.
Police say Smith had Rebello in a headlock when the officer opened fire.
Nassau County Attorney John Ciampoli says federal health privacy laws preclude the release.
