The incident happened just before 3:30 a.m. on March 16 at Mint restaurant and lounge on Ring Road in Garden City.
Police say 21-year-old Tyshaun Phillips opened fire into a crowd of people, shooting one man in the head and another in the leg.
The victim who was shot in the head, 21-year-old Emmanuel Barnett, died a few days later.
Phillips is charged with second-degree murder.
The investigation into this incident continues and potential additional charges are pending the introduction to the Grand Jury.
