Authorities say 31-year-old Mohammad Khan was swerving while driving on Old Country Road in Westbury around 9:20 p.m. Sunday.
His wife and 6-month-old daughter were in the car at the time.
The mother and child were removed from the scene by a friend.
During the investigation it was also discovered that Khan's license was suspended at the time of his arrest.
Kahn is charged with aggravated driving while intoxicated (a felony under Leandra's Law), aggravated unlicensed, endangering the welfare of a child, driving while intoxicated, aggravated driving while intoxicated, driving while intoxicated, two counts of aggravated unlicensed operation of a vehicle and multiple traffic violations including unregistered vehicle, uninsured vehicle and uninspected vehicle.
