Mom of Victoria's Secret dead baby in bag due in court

NEW YORK

Tiona Rodriguez was charged with misdemeanor shoplifting from the Victoria's Secret in Herald Square last year. Security noticed a foul odor and thought the girls were acting suspicious.

The medical examiner ruled her baby's death a homicide caused by asphyxiation.

It is Rodriguez's first court appearance since that ruling, but charges are not expected to be upgraded at this time.

According to the ME, the baby boy weighed around 8 and a half pounds and was around one day old at time of death.

Police say the 17-year-old Rodriguez had given birth to the baby at her friend's home in Queens the day before, and she brought it with them to the store.
