Passenger in Harlem subway train derailment to sue MTA

HARLEM (WABC) -- A passenger involved in the subway train derailment in Harlem Tuesday plans to sue the Metropolitan Transportation Authority for $5 million in damages.

Sheena Tucker was one of hundreds of passengers on an A train that went off the tracks and injured more than 30 people.

"It's time for the talking to stop and the MTA get the work done to make the trains safe for the people of our city," attorney Sanford Rubenstein said. "The MTA owes that to all New Yorkers."

MTA officials said two supervisors have been suspended while officials investigate the incident.

MTA spokesman Kevin Ortiz said the supervisors were responsible for oversight of work where the derailment occurred, and that they are suspended without pay during the formal review process.

Transit officials said it appears the derailment was caused by an improperly secured piece of replacement rail that was stored on the tracks.

The accident sent train riders tumbling to the floor and forced hundreds of passengers to evacuate through darkened tunnels.
