Police in Nassau County say Stephen Primm of Bay Shore opened fire on Joseph Fountain, 40, in New Cassel around 2 a.m. on New Year's Day.
Fountain was struck four times.
The shooting took place in front of a home where the victim and a third man were fighting.
Police say Primm has prior arrests for drugs, assault and burglary.
