The 40-year-old was charged with third degree assault, criminal obstruction of breathing and criminal mischief after the reported incident on Tuesday night.
He was arrested Wednesday and will be arraigned later Thursday in Hempstead.
The arrest comes weeks before he was to surrender to go to federal prison after being convicted of COVID-related fraud.
He was sentenced in April to 15 months in federal prison and was supposed to surrender to federal authorities on July 20.
Agnello pleaded guilty in federal court in 2024 to stealing $1.1 million from the Small Business Administration's Economic Injury Disaster Loan Program for coronavirus relief.
He admitted lying on pandemic relief loan forms about the number of employees at his business, Crown Auto Parts & Recycling, and what the money would be used for.
