Roy Johnson, Jr., and Devin Taylor are accused of opening fire in the lobby of a Courtyard Marriott hotel near the college campus in Poughkeepsie.

Paul Kutz, 53, was caught in the crossfire and killed.
The suspected gunman, 35-yea-old Johnson Jr., was being sought in two states - but managed to stay out of custody until Sunday's gunfire.
Johnson Jr. failed to appear for a July 12 court appearance in Georgia, where he is charged with felony charges of possession of cocaine with intent to distribute, possession of marijuana with intent to distribute, and possession of a firearm during the commission of a felony.
He was also determined to be at the scene of the fatal shooting of 28-year-old Darren Villani in the city of Poughkeepsie on Aug. 9, but his exact role remains under investigation.
Johnson and 26-year-old Taylor were arrested at the Courtyard by Marriott following the shooting of Kutz.
Johnson was charged with second-degree murder and second-degree criminal possession of a weapon, both felonies.

Taylor was charged with second-degree criminal possession of a weapon. Police say Johnson had a 9mm semi-automatic handgun and Taylor had a loaded .223-caliber rifle with no serial number, possibly a ghost gun.
The two were staying in a room at the hotel rented by a third person, who is cooperating.
Kutz is from East Northport, Long Island, and was staying in the hotel while visiting his youngest son.
Neighbors and friends spoke out earlier this week about Kutz and said his family was everything to him.

The husband and father of three was a financial planner and accountant who started Kutz and Company with his brother 30 years ago.
Outside of work, Kutz spent more than five years coaching all three of his sons as a Larkfield Northport Little League coach.
