Federal authorities say in March of 2025, the son of Yitzchok Sklar died from fentanyl exposure.
The 4-year-old was in the apartment with his father, and Sklar's girlfriend Ahuva Katzin, also his alleged drug supplier, at the time of the boy's exposure to fentanyl.
After 911 was called to report the boy was experiencing a medical emergency, Sklar was caught on surveillance video allegedly showing him leaving the boy in the apartment while running out with a black bag and returning without it.
The bag was found by law enforcement in a nearby car and contained fentanyl and heroin.
Sklar was previously charged along with the boy's mother, Miriam Elkayam, with abandonment of a child and criminal possession of a controlled substance in state court.
On Tuesday, Sklar and Katzin were both hit with federal charges: conspiracy to distribute narcotics resulting in death.
The charge carries a mandatory minimum sentence of 20 years in prison, and a maximum sentence of life in prison.
