Empire State Building climbers appear in court over viral engagement stunt
MANHATTAN (WABC) -- The couple who scaled the top of the Empire State Building and got engaged returned to court Monday as they face a series of criminal charges stemming from the high-profile stunt.
Ivan Kuznetsov, 32, and Angelina Nikolau, 33, captured attention around the world when they climbed the landmark's spire on July 1. The couple, who live in East Orange, New Jersey, were previously released under supervision.
Their court appearance on Monday morning lasted less than five minutes.
They held hands after learning there had been no grand jury action in their stunt. They were told to return to court on Sept. 29.
The recently engaged daredevils said little as they left court, but posted on Instagram over the weekend: "Whatever happens in court, we will respect the process and accept the consequences of our choices."
The pair face charges including reckless endangerment, burglary and criminal mischief. Prosecutors allege they gained access to restricted areas of the building and climbed more than 1,300 feet above Manhattan. Authorities say a lock on a 104th-floor security door was broken, allowing access to the building's broadcasting antenna. Investigators also believe the couple entered the building the night before and remained inside overnight before carrying out the climb.
According to the criminal complaint, security cameras captured the pair moving through a hatch on the 102nd floor around 5 a.m. Officials say officers responding to the incident were forced to navigate dangerous conditions to bring them down safely.
Defense attorney Jason Krinsky has argued the case was overcharged, saying the stunt did not place building occupants or visitors at risk. The couple, known online for scaling skyscrapers and other prominent structures around the world, have characterized the climb as a celebration of love.
Their love was on full display again Monday morning as Nikolau showed off her engagement ring that was initially taken from her by police.
They also shared a kiss for the cameras after court.
