New Jersey judge visits site where boy's remains were found

NEW BRUNSWICK, N.J. (WABC) -- A judge Wednesday visited the site in New Jersey where a child's remains were found 23 years ago, in preparation for his mother's murder trial.

State Superior Court Judge Dennis Nieves went to a marshy area in Raritan Center, an industrial park in Edison, where the body of 5-year old Timothy Wiltsey was discovered in 1992.

The judge will decide whether to allow prosecutors to bring jurors to the site.

Wiltsey's mother Michelle Lodzinski was arrested last year. Her trial is set to start in January.

Earlier in court Lodzinski appeared where the judge ruled on several motions that had previously been made by prosecutors and her defense attorney.

The motion made by the defense, asking the judge to dismiss the indictment because too much time had passed, was denied.

Lodzinksi faces a life sentence if convicted.

Lodzinski was living in Florida last year when authorities arrested her in the killing. She was long considered a possible suspect in her son's disappearance and death.

She's pleaded not guilty and remains jailed on $2 million bail.

Lodzinski's lawyer argued there was no physical evidence linking her to the death. But the judge found that Middlesex County prosecutors had provided enough circumstantial evidence.
