Hearing on Staten Island on whether to release Eric Garner grand jury records

STATEN ISLAND (WABC) -- A hearing was held on Staten Island Monday in connection with the police custody death of Eric Garner.

The state is suing to have the grand jury proceedings in Garner's case made public.

The panel opted not to indict NYPD officer Daniel Pantaleo in Garner's death.

The judge decided to hear oral arguments about publicly releasing the report on January 29th.

In December, a judge granted Staten Island District Attorney Dan Donovan's request to allow the release of limited grand jury material in the Garner case.

The information released does not include any evidence presented, only the following:

--Jurors sat for nine weeks

--Testimony was heard from 50 witnesses

--Those witnesses included 22 civilians and 28 cops, EMTs or doctors

--There were 60 exhibits, including videos, records and photos

--The grand jury was instructed in law regarding physical use of force
