Police say they pulled a car over on Route 32 near the Newburg City line on Saturday morning.
There were two adults and a child inside the car.
Police say the front seat passenger was asked to get out of the car and that's when they noticed a gun in the passenger's waistband.
Police say a struggle ensued and a police officer fired two shots from his service weapon.
It is believed that at least one shot struck the passenger.
The passenger was taken to Westchester Medical Center and is expected to survive.
Police say the passenger was armed with a stolen 9mm Berretta semi-automatic pistol. Police say there were 15 rounds in the magazine and one round in the chamber of the pistol.
No shots were fired from that gun.
Police say the case is still under investigation and they are still attempting to identify the passenger who was shot.
