NEW YORK (WABC) -- A woman from New York is calling for an investigation after she claims her family vacation ended in a violent sexual assault

Kristin Hernandez says she was stalked and raped by a waiter at the Hard Rock Riviera Maya in Mexico back in April.

Her attorney Gloria Allred filed a complaint with the Better Business Bureau to investigate.

They also want to speak with New York City officials about a Hard Rock hotel coming to the Times Square area in 2019.

The single mother claims the Hard Rock discouraged her from notifying police about the assault and has been insensitive.

"I would like the Better Business Bureau to investigate Hard Rock International," said Hernandez. "I hope that the New York City councilmen will agree to meet with us regarding what happened to me and how Hard Rock International has turned their corporate back on me."

Hernandez says she suffered nerve damage in her wrist after getting blood drawn at the hospital.

She claims the injury forced her to step down from her job as a registered nurse.
