But a few days ago, Miller got an apology letter from the state of New Jersey, informing him Mark's body was still at the medical examiners office in Newark and that the one they cremated and buried was actually someone else.
Miller's brother's body is badly decomposed now. The mistake discovered after a funeral company came to pick up the remains of an indigent, unclaimed person for burial. Mark's body had been at the funeral company since October of 2007.
"We put my brother to rest and thought it was a time for mourning and healing," said John Miller.
New Jersey's criminal justice director promising a full investigation.
"What happened is totally unacceptable and we intend to hold people accountable," said Matthew Mendelson, the Miller family lawyer. .
