Queens Halloween attempted rape suspect arrested

Police in Queens have arrested a suspect in the attempted rape of a young college student heading home from a Halloween party in Flushing.

The incident happened near Melbourne Avenue and Kissena Boulevard just before 5 a.m. on November 1, after the 23-year-old victim got off an MTA bus.

Authorities took 24-year-old David Diaz into custody Wednesday.

Police say Diaz man followed the woman, a student at Queens College, then punched and choked her before trying to drag her into some bushes.

She fought back, and the man fled when an area resident heard her screams for help. The witness yelled to the suspect that he had called 911.

The victim's roommate spoke to Eyewitness News.

"He was saying stop fighting before you die," Su Wei said. "She actually bite his hand so she could scream out and get help."

Diaz is charged with attempted rape.
