Police: Man kills brother over cheeseburger after Cinco de Mayo festivities in Florida

ST. CLOUD, Fl. -- Police say a man killed his own brother after an argument over a cheeseburger.

The incident happened after Cinco de Mayo festivities in Florida.

According to St. Cloud police, 25-year-old Benjamin Middendorf says he was being bullied by his older brother Nicholas.

When they both went for the cheeseburger, investigators say Benjamin had enough and shot and killed his older brother.

"You know, it is Mother's Day weekend and in this particular case, the mom has lost two sons," says Denise Robert of the St. Cloud Police Department. "One whose deceased, and then the other son whose now incarcerated and facing homicide charges."

A judge has ordered the little brother to be held without bond.
