Orkiszewski was jailed in May.
Police say he discussed the scheme with fellow inmates at the Yaphank Correctional Facility, using code words to describe buying a gun from the "hardware store."
His lawyer denied the claims.
"He finds himself in jail, he's frustrated, he's angry, he's depressed," attorney Anthony Grandinette said. "He makes comments every man has made throughout the course of a lifetime. Those comments, he regrets. However, there was absolutely no intent of carrying out any statement that he made out of sheer frustration."
Orkiszewski pleaded not guilty to the charges.
