The judge says the video attracted more than 700,000 Internet viewers before it was removed Jan. 17.
The 37-year-old woman says in her $5 million lawsuit against Szul Jewelry Inc. that she did not consent to the use of her image "to simulate a female having an orgasm."
The married graduate student in elementary education was paid $200 for the ad.
A lawyer for Szul did not immediately return a call for comment on Monday.
