2nd arrest made in Newburgh drive-by

NEWBURGH Police say 21-year-old Daniel Correa is charged with firing the fatal shots that hit Jeffrey Zachary Tuesday night.

Zachary was standing across the street from his house when he was hit. He died an hour after the shooting.

Sixteen-year-old Joshua Torres was arrested Tuesday night. Police say he was driving the car when Correa fired out the window.

Both suspects are charged with second-degree murder.

During the course of the investigation, police say the vehicle that was used in the crime was recovered, as well as a handgun they say is consistent with the weapon used in the incident. Both the weapon and the vehicle were reportedly found where the suspects abandoned them, in the rear of a parking lot at an apartment complex.

Newburgh police say they were called to the area of Dubois Street just after 10 p.m. Tuesday for a report of a person shot.

Upon their arrival at the scene, the victim had already been taken to St. Luke's Hospital by people on the street.

Authorities say Zachary was standing with several people when he was shot. A passing ambulance was flagged down and took him to the hospital before the cops responded.

The teen's brother, 19-year-old Trent Zachary, was shot and killed in a drive-by shooting in March 2005.
