Police first thought it was a hit and run, but they now say it was an accident.
Police received a 911 call from a driver Sunday night saying he hit something on Montauk Highway.
Further investigation determined the caller had hit 32-year-old Mendez.
The driver has been interviewed by police. It's not clear if he will face any charges.
