Mistrial unlikely after Espada juror refuses to deliberate

NEW YORK

The judge met with the jury Thursday morning after one juror refused to deliberate.

The jury did resume deliberations despite the setback. The judge reminded all 12 jurors of their oath and obligations.

The judge did not single out any particular juror, but told them they were required to keep an open mind as they decided Espada's fate.

The former lawmaker spoke out, blasting the governor for blocking funds to his Soundview health clinic. It is the same clinic that he is accused of embezzling money from.

"No one should be backdoored or threatened away from a position that they know in their mind and heart to be right," he said.

At this point, it does not appear that the judge will declare a mistrial.
