HUNTINGTON STATION (WABC) -- The Nassau County police officer accused of shooting an unarmed taxi driver is now being stripped of his badge.

Investigators say Anthony DiLeonardo was off-duty and not in uniform when he opened fire on the man during a dispute in Huntington Station three years ago. Police say he had spent the night drinking with another officer.

He allegedly fired his service weapon five times at the cab driver as the cabbie was backing away with his pregnant girlfriend in the passenger seat Feb. 27, 2011.

DiLeonardo was most recently assigned to Williston Park, where reports say he was prohibited from patrol duty.

DiLeonardo was hired in November 2007. His termination was announced Monday.

His attorney declined to confirm his the firing but said he would sue if he was terminated. DiLeonard also did not comment.
