Girl plans to sue over police rape claim

NEW ROCHELLE Assistant District Attorney Heide Mason mentioned the 17-year-old's notice of claim during a Friday court session in the criminal case against New Rochelle Sgt. David Rodriguez.

Defense attorney Stephen Worth said outside court that the lawsuit is the motive for the girl's rape claim.

Mason also confirmed that Rodriguez's DNA did not match the male DNA found on gum the girl said she chewed during the alleged rape.

Rodriguez came into court with 20 supporters, including his wife, WNBC-TV news anchor Darlene Rodriguez.

On Feb. 8, officers arrested the girl's boyfriend on a domestic violence charge. She claims Rodriguez returned later and raped her.
