The driver involved in the hit-and-run accident that killed a grandmother on Staten Island returns to court Wednesday.

Brian McGurk, 40, is charged with leaving the scene of a fatal accident.

He is currently free on $50,000 bail

McGurk turned himself into police hours after allegedly striking 56-year-old Clara Almazo in West Brighton.

Almazo was walking home from church with her grandson at the time. Her final act was to push the little boy out of the way.

A funeral was held for Almazo on Tuesday. She is being flown to her native Mexico for burial.
