Kang Chun Wong, 84, was photographed bloodied after an encounter with police on the Upper West Side in January.
The officers say Wong had engaged in disorderly conduct when they gave him a ticket for crossing the street illegally.
Wong has filed a $5 million lawsuit against the NYPD.
His family released a statement saying they were gratified with the decision.
Police Commissioner William Bratton has said he wasn't aware of any excessive force used by officers and that witnesses claimed the injuries occurred from a "fall to the ground."
The district attorney's office declined to comment.
