The victim was a 50-year old man. His identity was being withheld until his family could be notified.
Police say the livery cab driver, 35-year-old Sergey Osadchuk, stayed at the scene. Investigators said a blood-alcohol test determined he was intoxicated.
Additional charges were expected against Osadchuk.
