Rios is charged with the rape of a 34-year-old nanny arriving for work in a building on East 105th Street.
The suspect allegedly tackled her in the lobby, pulled her into the elevator and raped her at knife point.
Authorities say the suspect may have followed her from the subway station at 103rd Street and Lexington Avenue.
